On August 31, the Constitution and Justice Commission (CCJ) of the Chamber of Deputies approved a proposal to increase the limit for the inclusion of Simples Nacional and Individual Microentrepreneurs (MEI). The new values take into account the official inflation (IPCA) accumulated between December 2006 and March 2022. Change in Simples Nacional billing limit and inclusion of two MEI employees
As previously mentioned, in addition to the increase in the values of the Simples Nacional classification ceiling, due to the official inflation (IPCA), the proposal also allows the MEI to be hired, as long as it does not exceed two employees in that modality. Before this change, only one person in this condition was allowed. According to the approved wording, the annual maturity limits are now as follows:
- For MEI, the variation is from the current BRL 81 thousand to BRL 144,913.41;
- For microbusinesses, increase from BRL 360 thousand to BRL 869,480.43;
- For small companies, the range is between R$ 4.8 million and R$ 8,694,804.31.
The new values should come into effect in 2023 and will be readjusted annually for inflation. However, for the proposal to be validated it still needs to be approved by the plenary of the Chamber.
According to the rapporteur of the CCJ, Deputy Darci de Matos (PSD-SC), “who protects the Brazilian economy are small businesses. Thirty percent of the Gross Domestic Product (GDP, sum of goods and services produced in the country), or 13 million MEIs, come from small companies”.
Enlargement of the frame as MEI
The project amends the Micro and Small Business Law and is born in the Senate. The approved document also modifies the sharing of the Simples Nacional and the annexes of the law, also establishing an annual update. The language that came from the Senate is restricted to discussing new framework limits, raising the MEI limit to R$ 130,000. Additionally, it provides for the possibility for the MEI to hire up to two employees, a point that remains in the approved substitute.
